Applied may offer features and functionality of the Software that utilize, incorporate, Integrate, or interact with machine learning and other artificial intelligence solutions (“AI Features”), including those that may be provided by third parties to generate responsive text, identify differences in materials, analyze data, and provide other outputs (collectively “Outputs”). Licensee acknowledges and agrees that Applied and AI Features may gain access to and use Customer Data and Licensee Data in connection with the AI Features, including but not limited to provide Outputs and improve AI Features, models, software, and services, to which Licensee hereby expressly consents. As between Licensee and Applied, Applied shall retain ownership of all AI Features developed pursuant to these terms. AI Features are designed in accordance with Applied's AI principles to be developed with ethical considerations in mind to be fair and non-discriminatory, to be transparent in their decision-making processes, to be accountable for their actions, and to adhere to applicable data privacy laws and regulations. Information provided by Licensee to the AI Features may not be kept in confidence, and Licensee should not disclose any information to the AI Features that it does not want used for the foregoing purposes. AI Features and Outputs are provided “AS IS”, are not designed for or intended to meet Licensee’s regulatory, legal, or other obligations and Licensee is solely responsible for determining suitability of AI Features and Outputs. Outputs are machine generated, may not be complete, and may contain errors, inaccuracies, and misleading, offensive or biased content, and Licensee agrees not to bypass or attempt to bypass any features designed to block such content. Applied disclaims any and all liability and responsibility that may arise from the use of the AI Features or Outputs, including but not limited to breach of a third-party rights, use with third-party hardware or software, security issues, or failure to comply with privacy, discrimination, defamation, confidentiality, consumer protection, security laws or other legal requirements.
